This Privacy Policy outlines our ongoing obligation to you in respect of how we manage and protect the Personal Information that you disclose to and entrust us with as we deliver goods and services during our engagement.

The Australian Government’s Privacy Act 1988 (the Act) imposes obligations on the way your Personal Information is handled by organisations, including ours. Significantly, the Act sets down the Australian Privacy Principles (the APP) which govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

  1. What is Personal Information and how do we collect it?

    1. Personal Information is defined under the Act as information or opinions, whether true or not, that can identify an individual.

      Personal Information we collect from you may include names, addresses, email addresses, telephone (fixed and mobile) numbers, government identification and payment information.

    2. Personal Information we collect is obtained:

      1. by appointments and consulting with you, either in person or online;
      2. by corresponding with you by telephone (fixed point), mobile telephone and email;
      3. through our commercial agreements;
      4. via media, social media and publications (online and in print);
      5. via our website and use of our online contact form;
      6. directly through our online shopping platform and online account sign up;
      7. automatically by online cookies and analytics; and
      8. through authorised third parties.
    3. Importantly, we do not guarantee:

      1. the security of website links provided by authorised third parties;
      2. the activities of the authorised third parties; or
      3. the privacy policy of authorised third parties
  2. Why do we collect our Client’s Personal Information?

    1. We only collect Personal Information that is reasonably necessary for the provision of our goods and services to you.

    2. We collect your Personal Information for the primary purpose of providing our:

      1. goods and services;
      2. information to you regarding our products and services; and
      3. for directly marketing to you.
    3. We may also use your Personal Information for secondary purposes that are closely related to our primary purpose, under circumstances where you would reasonably expect such use or disclosure of your data, including to shipping/courier partners, marketing providers, payment providers, our online shopping platform provider.

    4. When we collect your Personal Information, where appropriate and where possible, we will explain to you why we are collecting your data, and how we plan to use it.

    5. Importantly, you may unsubscribe from our mailing and marketing lists at any time by contacting us in writing, either by email or post, and informing us you no longer wish to receive these communications.

  3. What is Sensitive Information?

    1. Sensitive Information is defined under the Act as information or opinions about such things as:

      1. an individual's racial or ethnic origin;
      2. sexual orientation;
      3. political opinions or memberships of a political association;
      4. religious or philosophical beliefs;
      5. membership of a trade union or other professional body; and
      6. criminal records or health information.
    2. We do not foresee the need to ask you for your Sensitive Information, and our use of this type of information is limited during the routine operation of our business.. However, if we do require Sensitive Information, we will inform you as to the reason why we require this data and assure you it will only be used by us:

      1. for the primary purpose for which it was obtained;
      2. for a secondary purpose that is directly related to the primary purpose;
      3. with your consent.
  4. Third Parties

    1. Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties, including:

      1. if you give consent to a third party to give the Personal Information to us; or
      2. if we are required or authorised by law to collect your Personal Information from someone other than you.

        In such a case, we will take reasonable steps to ensure that you are made aware your Personal Information was provided to us by the third party.

        Examples of where we may collect from a third party include:

      3. online shopping platforms;
      4. website hosting services and online enquiry forms;
      5. payment providers
    2. If we are in receipt of Personal Information that we did not solicit directly, we will take reasonable steps within a reasonable time period:

      1. if we did not collect the Personal Information independently and would not have been able to do so, to ensure that your information is de-identified and destroyed; or
      2. if we determine we could reasonably collect the Personal Information if we were to actively solicit it, to notify you that we are in receipt of your Personal Information.
    3. Importantly, Personal Information provided to us by a third party will be used, stored, secured, disclosed and disposed of in accordance with our Privacy Policy.

  5. Disclosure of Personal Information

    1. Routinely, we will limit our use of your Personal Information for the primary purpose we originally collected it for. However, your Personal Information may be disclosed in the following circumstances:

      1. if you provided consent to the use or disclosure of your Personal Information to third parties. For example, to our delivery partners, subcontractors, or for the purposes within a commercial agreement you have entered with us;
      2. where required or authorised by law, or a Court or Tribunal Order;
      3. at the reasonable request of an enforcement body for enforcement related activities.
    2. We will not disclose Government Identifier numbers unless it is reasonably necessary:

      1. to verify your identity for the purposes of our business activities or operations;
      2. to fulfil our obligations to a State or Territory Authority or Agency
      3. is necessary or authorised by law or a Court or Tribunal
      4. at the reasonable request of an enforcement body for enforcement related activities
    3. Examples of a Government Identifier number are your Australian Passport, Victorian Driver’s (or equivalent) Licence or Medicare number.

  6. Security of Personal Information

    1. Your Personal Information is stored in a manner that reasonably protects it from interference, misuse and loss. Additionally, we store your Personal Information to protect it from unauthorised access, modification or disclosure. Security measures we employ may include, but are not limited to, data encryption, internet Security Safeguards such as SSL Certification and restricted access by password, and two factor authorisation.

    2. Most of the Personal Information is or will be stored in the Customer Relationship Management Software Systems we use which are Cloud hosted Amazon Web Services centralised to and data stored within Australia.

    3. Personal Information will be stored by us for a minimum of 7 years for Australian Government legislative and regulatory compliance.

    4. When your Personal Information is no longer needed for the primary purpose for which it was obtained, we will take reasonable steps to destroy and/or permanently de-identify it.

    5. In the event we are required to disclose your Personal Information overseas, we will take steps that are reasonable in the circumstances to ensure any overseas recipient does not breach the APP.

  7. Mailing Lists

    DGS will collect information that you provide to us when signing up to mailing lists, registering for business events or when submitting feedback to us.

    1. We use Mailchimp, as an integrated tool to provide online tools to create, send and manage emails. Mailchimp may collect personal information, such as distribution lists, relating to these email addresses. We will only use this information to:

      1. create, send and manage emails relating to the work of DGS; and
      2. measure email marketing campaign performance
    2. Mailchimp may transfer this information to third parties where required to do so by law, or where such third parties process the information on behalf of Mailchimp.

    3. Mailchimp is based outside of Australia and the information collected about your use of the website (including your IP address) will be transmitted to and stored by Mailchimp data centres located in the USA and around the world.

    4. We are required by law to inform you that by subscribing to our mailing lists:

      1. You consent to your personal information being collected, used, disclosed and stored as set out in Mailchimp's Privacy Policy and agree to abide by Mailchimp's Terms of Use available on the Mailchimp website
      2. You understand and acknowledge that DSG utilises a Mailchimp platform, the origin of which is USA, with data centres located outside of Australia.
      3. As the data centres are located within the USA, the relevant legislation of the USA will apply.
      4. The APP contained in the Act do not apply.
      5. You understand and acknowledge that Mailchimp is not subjected to the Act and you will not be able to seek redress under the laws of Australia, you will need to make a claim for redress under the Laws of the USA.
    5. You can opt out of our mailing list if you choose the ‘unsubscribe’ service provided by Mailchimp in every email or contact us below.

  8. Access to your Personal Information

    1. You may request access to the Personal Information we hold about you. You may also update and/or correct your Personal Information, subject to certain exceptions.

    2. DGS will not charge fees for your access request. However, we may charge a reasonable administrative fee for providing you with a copy of your Personal Information that we store. For example, if you request that we print and send you a copy of the information stored on our CRM we may charge you for printing, postage and administrative staff time.

    3. In order to protect your Personal Information and ensure its integrity we will require you to:

      1. present photo identification, such as your passport or driver's licence, to verify your identity; or
      2. if not presenting in person, send a certified copy of your original photo identification, such as your passport or driver's license, to verify your identity. before we release Personal Information to you.
    4. If you wish to access your Personal Information, please contact us in writing (by our email or postal address).

  9. Maintaining the Quality of your Personal Information

    1. It is an important to us that your Personal Information is current and up-to-date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date.

    2. If you find that the information we have on record is not up-to-date or is inaccurate, please advise us as soon as practicable and we will update our records.
